Terms of Service
Effective August 11, 2026. By creating an account or using Hedge Fun, you agree to these terms. If you don't agree, please don't use the service.
Plain-English summary (not a substitute for the terms below):
- Hedge Fun is a portfolio-tracking and gamification tool. It is not a broker, not an investment adviser, and doesn't give financial advice.
- The “Fantasy” duels/leagues and the sports-betting comparisons are for entertainment and perspective only — no real money is ever wagered, held, or paid out through Hedge Fun.
- You're responsible for the accuracy of what you enter or import, and for your own investing decisions.
- The service is provided “as is,” with no uptime or accuracy guarantees.
1. Who We Are and What This Is
Hedge Fun (“Hedge Fun,” “we,” “us,” or “our”) is a web application that lets you manually log your own stock trades and view them as a gamified “trading card” portfolio, complete with performance tiers, career statistics, achievements, and optional friend-vs-friend “Fantasy” competitions based on real market performance of stocks you and your friends select.
Hedge Fun is not a brokerage, bank, payment processor, investment adviser, or financial institution of any kind. It does not execute trades, hold your money or securities, or connect to your real brokerage accounts. Every trade you see in the app is one you manually entered or imported — Hedge Fun has no independent knowledge of what you actually own.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use Hedge Fun. By creating an account, you represent that you meet these requirements and that all information you provide is accurate.
3. Your Account
You're responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access. We reserve the right to require email confirmation before an account can sign in, and to suspend accounts that appear fraudulent, abandoned, or in violation of these terms.
You may set an optional username, which is shown to other users (e.g., friends and Fantasy opponents) in place of your email address. Don't choose a username that impersonates another person, infringes a trademark, or is otherwise unlawful or abusive.
4. Content You Provide
You may manually enter trade data, or import it from a CSV file, PDF statement, or photo/screenshot of your brokerage account (“Your Content”). You retain ownership of Your Content. By submitting it, you grant Hedge Fun a limited, non-exclusive license to store, process, and display it back to you, and — where you explicitly opt into a Fantasy duel or league — to share the specific ticker symbols and their performance (never your cost basis, share counts, or dollar values) with your chosen opponent.
You're solely responsible for the accuracy of Your Content and for ensuring you have the right to submit it. Uploaded photos and PDF statements are parsed entirely in your own browser (see our Privacy Policy for details) — Hedge Fun still recommends you review any imported rows before confirming them, and avoid uploading statements containing information you don't want extracted, such as account numbers.
5. Not Investment Advice
Nothing on Hedge Fun — including performance tiers, achievements, career statistics, the growth projection calculator, or any comparison to a benchmark like the S&P 500 — is or should be construed as investment, financial, tax, or legal advice, or as a recommendation to buy, sell, or hold any security. Hedge Fun is not a registered investment adviser or broker-dealer under any securities law. Past performance shown in the app is not indicative of future results. You are solely responsible for your own investment decisions, and should consult a qualified professional before making them.
6. Fantasy Duels, Leagues, and Betting Comparisons
The “Fantasy” duel and league features let you compare the real market performance of stocks you and a friend each select over a week. These features are for entertainment purposes only. No cash, cryptocurrency, or anything else of monetary value is wagered, collected, held, or paid out by Hedge Fun in connection with any duel, league, streak, or achievement — winning is purely a matter of in-app bragging rights.
Hedge Fun also displays informational comparisons between investing outcomes and the statistical economics of sports betting (for example, average sportsbook hold rates), citing named third-party research. These comparisons are illustrative commentary intended to provide context on investing versus gambling as a category — they are not, and should not be read as, an endorsement, facilitation, or promotion of gambling, nor as a description of any feature that lets you gamble within Hedge Fun. Hedge Fun does not offer, facilitate, or accept sports betting or wagering of any kind.
7. Market Data and Third-Party Information
Stock prices, historical closes, and company information shown in Hedge Fun are sourced from third-party providers (currently Finnhub and Yahoo Finance) and may be delayed, incomplete, or occasionally inaccurate. Hedge Fun does not guarantee the accuracy, timeliness, or completeness of any market data displayed, and is not responsible for decisions made in reliance on it.
8. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose, or to impersonate any person or entity.
- Attempt to gain unauthorized access to any account, system, or data.
- Scrape, reverse engineer, or interfere with the normal operation of the service.
- Upload malicious files or content that infringes another person's rights.
- Create accounts in bulk, in an automated fashion, or for the purpose of manipulating Fantasy results, streaks, or achievements.
- Harass, abuse, or threaten other users via the friends, duels, or league features.
We may suspend or terminate accounts that violate this section, with or without notice.
9. Intellectual Property
The Hedge Fun name, logo, design, and underlying software are owned by Hedge Fun or its licensors and protected by applicable intellectual property laws. These terms don't grant you any right to use Hedge Fun's branding or code except as necessary to use the service as intended.
10. Termination
You may stop using Hedge Fun and request deletion of your account at any time (see our Privacy Policy). We may suspend or terminate your access to the service at any time, for any reason, including violation of these terms, with reasonable efforts to notify you where practical.
11. Disclaimer of Warranties
Hedge Fun is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted, secure, error-free, or that any data (including market data or imported trade data) is accurate.
12. Limitation of Liability
To the fullest extent permitted by law, Hedge Fun and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or investment value, arising from your use of or inability to use the service, even if advised of the possibility of such damages. Hedge Fun's total liability for any claim arising from these terms or your use of the service will not exceed one hundred U.S. dollars ($100).
13. Indemnification
You agree to indemnify and hold Hedge Fun harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these terms, your misuse of the service, or content you submit.
14. Governing Law
These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles, except where Section 15 (Dispute Resolution & Arbitration) requires disputes to be resolved through arbitration instead of court.
15. Dispute Resolution & Arbitration
Informal resolution first. We'd prefer to resolve any disagreement informally — please contact us first at thejfleish@gmail.com and give us 30 days to try to work it out before starting a formal proceeding.
Agreement to arbitrate. If informal resolution doesn't work, you and Hedge Fun agree that any dispute arising out of or relating to these terms or your use of the service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court instead if it qualifies. The arbitration will be seated in Virginia, and Virginia law will apply to the substance of any dispute.
Class action waiver: you and Hedge Fun each agree to bring claims only in an individual capacity, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
Either party may opt out of this arbitration agreement by emailing thejfleish@gmail.com within 30 days of first agreeing to these terms, clearly stating your intent to opt out — in that case, either party may instead bring claims in the state or federal courts located in Virginia, and both parties consent to personal jurisdiction there.
16. Changes to These Terms
We may update these terms from time to time. If we make material changes, we'll update the effective date above and, where practical, notify users in-app. Continued use of Hedge Fun after changes take effect constitutes acceptance of the revised terms.
17. Severability
If any provision of these terms is found unenforceable, the remaining provisions will remain in full effect.
